PAYMENTS

Our aim is to make things as easy as possible for our clients. We have a few variations of payments:  

Monthly Subscriptions: 

Childrens’ Classes: The subscriptions are worked out over a 12 month period. We are open 42 weeks of the year. The annual class cost is worked out over a 42 week period and is divided by 12 months to keep the payment the same from month to month and more affordable. The monthly payment is due on the day of the month that you sign/ed up and is payable monthly thereafter. Payments are due each month regardless of whether the studio is closed for school holidays. Contracts are automatically renewed after 12 months unless 1 months notice is given.

NOTE: For subscriptions purchased prior to the start of March 2020, all payments are due on the 1st of every month for 12 months of the year, this ensures all classes are paid.

Adult Classes: The unlimited subscription is payable each calendar month. The monthly payment is due on the day of the month that you sign/ed up and is payable for 12 months. Payments are due each month regardless if the studio is closed (for example Christmas and Bank Holidays). Contracts are automatically renewed after 12 months unless 1 months notice is given.

Pay as you go: Adult Classes only (Children’s classes are subscription only)

You can pay for any adult class as you go. Payment is due as soon as the class has been booked and is payable even if you don’t attend the class unless you have given us 48 hours notice of cancellation. All pay as you go payments will need to be received in advance of the class booked. Payments can be made via https://www.simplydancenottingham.co.uk/payment/

VENUE/LIVE CLASS PROBLEMS

If for any reason the venue that is scheduled to be used is unavailable or the live class is not able to go ahead (regardless of the reason), we will do our best to arrange a replacement venue or if this isn’t possible, we will live-stream the classes. 

TERMINATION OF CONTRACT

Although we don’t want to see anyone leave, we understand that situations change and the need to cancel may be necessary.

If you wish to cancel the contract with us, we require one months notice for each class attended to be given to us in writing to [email protected] (text messages and messages via social media will not be accepted). Your notice period will be taken from the date we receive your email. You will be permitted to continue with the classes until the notice period has ended.

For example: If you are contracted for 2 classes per month at £17.50 each and you give us your notice by email on 15th September. You will be required to pay for a full month up to and including 14th October. In this example, it would be £35.00. Payments will be calculated pro-rata where applicable.

If you wish for your child to rejoin at a later date, you will be required to pay a rejoining fee for administration purposes if this is after 3 months.

If you pay a Standing Order via your own bank, unfortunately, we do not have any control over these payments and therefore cannot cancel from our end. Please ensure that you cancel your payments after your notice period has finished. We do not offer refunds for payments that have been sent to us where they have not been cancelled.

LATE, MISSED OR CANCELLED PAYMENTS

Late payments: We totally understand that financial hardship can fall upon us at any time. Please communicate with us if you have a problem with paying and we can try and come to some form of payment plan to assist.

Late, missed or cancelled payments without notification of one months notice (refer to Termination of Contract above) will be subject to a £40 late payment charge. 

In addition, any payments made later than the due date (refer to monthly subscriptions above) unless otherwise authorised by Simply Dance in writing to you, will be subject to a late payment charge of 10% interest for up to seven days late and 20% thereafter. 

If payments are more than two weeks overdue, students will be unable to participate in any classes until payment is made in full (this includes any late payment fees and interest added to the account).  Only when the account has been settled in full will you be able to then participate in the classes.  If the account is not settled in full within one month of the due date, we reserve the right to offer your place to somebody else on a waiting list.

Outstanding payments: If payment requests are ignored then we may be forced to take legal action and external debt collectors may be actioned to recoup any outstanding money. Non-payment of classes is something we take very seriously and do not accept unless otherwise discussed or a payment plan is in place outside of our Terms and Conditions.

REFUNDS

Joining Fees: Joining fees are non-refundable (this is simply because of the administration time required).

Subscriptions Fees:  Subscription fees are non-refundable.  Subscriptions require a cancellation notice (see the termination of contract above).

Ticket Refunds:  All event tickets are non-refundable once purchased regardless of the reason (e.g. this includes shows and festivals etc). This applies even if the child no longer attends the classes.

Costume Refunds: Unfortunately, these are not refundable unless it is still within the retailer’s returns policy.  We do not aim to make any profit from costumes.

Show Registration Fee: Any show registration fees are non-refundable. This is due to the administration required for each event.

CLASS AND HOLIDAY CLUB POLICY AND CODE OF CONDUCT

Clothing: All students need to be in the appropriate dance/sports clothing and footwear (see list below under Health and Safety). 

Jewellery: No jewellery is to be worn to class at any time. If any jewellery cannot be removed then it should be covered with a plaster. 

Hair: Hair is to be tied up so it is out of the face to keep vision clear and to avoid any distractions when learning.

Arrival Time: Students must be ready for classes 5 minutes prior to the start time to ensure a smooth transition between classes.

Behaviour: Teachers and staff expect respect and polite behaviour from all involved with Simply Dance at all times.  Any inappropriate behaviour will be recorded and suitable action will be taken. If any inappropriate behaviour takes place from either staff or customers, we ask kindly that it be reported to us to help resolve the situation as this too will not be tolerated.

If a student’s behaviour in class is unacceptable, disrespectful or distracting and disrupting to the others in the class, we will discipline them appropriately or ask them to leave if the behaviour persists. We are within our rights to ask anyone to leave the premises at any time if a behaviour is deemed inappropriate and threatening.  In the event of this being a minor, the appropriate guardian will be contacted.

HEALTH AND SAFETY

Uniform: Appropriate uniform to be worn to all classes.  Examples below:

A Simply Dance logo item is compulsory for all children students and must be worn to all classes over leotards and will be required for all events throughout the year. This will ensure ‘out and about’ helpers and staff can easily locate our children. Although we are a no-pressure dance school with no exams this does not mean we are untidy and careless with what we do.  A uniform is very important to the improvement and safety of the children/customers who attend our classes. Correct dancewear allows teachers to see all children clearly and ensure that technique and posture is correct to prevent injuries.  Items are available to purchase from the studio, please contact us for more information.

Acro – Leotard, leggings or leggings and crop and bare feet.

Street – Hip Hop, Commercial – Joggers/leggings, t-shirt and trainers.

Tap – Leotard, leggings, tights, slim fit joggers, t-shirt and tap shoes.

Ballet – Leotard, tights, leggings, skirt, slim fit joggers, t-shirt and pink leather or canvas ballet shoes.  Cardigan optional.

Musical Theatre – Leggings/joggers t-shirt or leotard, bare feet or black jazz shoes depending on the routine.

Food: It is extremely important that no food items or anything containing nuts is brought into the studios or anywhere we are performing.

YEARLY EVENTS (applicable to Children’s Classes)

Annual show: This is generally held in the first half of every year. All students taking part in any Simply Dance classes will be invited to be part of the show via a  registration process. This is normally 3 to 5 months prior to the show date. Classes may be affected for those students who choose not to take part in the show. The venue may change from year to year depending on the growth of the business. Students performing will be required to have costumes for each dance routine they participate in. 

Costumes – We like to keep costume prices down to keep the event more affordable.  Costumes generally cost the guardian of the child attending anything up to £30 per class (you will be notified prior to ordering if the costumes are likely to exceed that figure). 

Tickets – For those wishing to watch the show, tickets will need to be purchased prior to the event.  Tickets generally cost between £14 and £20 per ticket depending on the location of the show. Children who are able to occupy a seat on their own and are walking will also require a ticket at the child price. Tickets are on a first-come, first-served basis and are always extremely popular.  Simply Dance does not accept any liability for sold out events where tickets are no longer available for sale. Any show tickets purchased are non-refundable.

Show Registration Fee: A fee of between £20 & £25 for each child will be payable 3 to 5 months before the show is due to commence. This fee covers the following:

  • A downloadable programme
  • Costs towards the theatre hire
  • In-theatre rehearsal fee
  • Show administration – including sourcing costumes (does not include the cost of the costumes – see above)
  • Staff chaperone and DBS licence costs
  • Staff costs for the theatre rehearsals and show day

Annual Awards and Events Ceremony:  This is held in June/July.  All students attending Simply Dance will be invited to an Annual Awards Event, each child attending the event will receive a medal for their achievements with Simply Dance and special achievement trophies will also be awarded to selected students. 

Tickets – This is a ticketed event for all, costing between £10 and £25 depending on event location.

Village Fairs: We take part in many village fairs and events throughout the year – these change from year to year but a regular one we attend on a yearly basis is the Arnold Carnival. We select certain classes to take part in these events which will be discussed with you and all relevant information is given a few months prior to the event to ensure you are able to attend.

Special Events: We do provide special events every couple of years including performing in London and Disneyland Paris. These events will come at a cost but we try to keep them as affordable as possible. If invited to attend any event such as these you will be given a 14 day period to decide if you can attend or not. Rehearsals for these events will be separate from dancing and held on a Friday evening for 2 hours. There will be a charge for this class to cover staff and any additional costs.

For all events, extra rehearsals may be required.

Additional Terms and Conditions for other events will be detailed in information packs for each event. If events are organised via an outside organisation where payment is required directly to them, for any refund requests, you will need to contact the organisation directly. Simply Dance accepts no responsibility for other organisations Terms and Conditions.

DISCLAIMER

You agree that you or your child are participating in the dance classes, fitness classes and events at your own risk and that we shall not be liable under any circumstances for any matter arising out of your participation (other than for matters for which we are not legally able to exclude or limit liability).

Due to the nature of coaching, we do not guarantee any particular result. We will endeavour to ensure that all information that we provide is accurate and up-to-date but we shall not be liable for any claims arising from such information being inaccurate or not up-to-date or otherwise.

It is your responsibility to keep us updated on any changes in respect of you with your personal emergency contact information. This is especially important where children are concerned and left in our care.

The materials are protected by copyright laws and treaties around the world. Where we are legally able to do so, we grant you a worldwide, non-exclusive, royalty-free, revocable licence to use the materials for your own purposes only. You may not reproduce in any format or share or disclose to any person any part (or all of) the materials without our prior written consent.

Other than the above, we do not grant you any other rights in relation to the materials and all other rights are reserved. For the avoidance of doubt, you must not adapt, edit, change, transform, publish, republish, distribute, redistribute, broadcast, rebroadcast, or show or play in public any or all of the materials (in any form or media) without our prior written permission.

You may not without our prior written consent make any audio or visual recordings of any part of dance classes, fitness classes and events.

We take the protection of our copyright very seriously. If we discover that you have breached the terms of the above licence, we may bring legal proceedings against you and seek monetary damages and an injunction to stop you from using the materials. You could also be ordered to pay our legal costs.
